Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the services provided by MediPlace (Pvt) Ltd.(“MediPlace,” “we,” “our,” or “us”), including all information, coordination, and facilitation services made available through our website, mobile platforms, or communication channels. By using our services, submitting personal information, or booking a healthcare service through MediPlace, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
MediPlace acts solely as a facilitator and coordinator between clients and independent healthcare professionals or service providers. We do not provide healthcare services directly and do not assume responsibility for the advice, treatment, or service quality delivered by third-party providers. These Terms apply to all clients and users of the MediPlace platform and are subject to change at the sole discretion of the Company.
If you do not agree with any part of these Terms, you must refrain from using our services.
Definitions and Interpretation
- Healthcare Service Providers – includes any individual or organization that offers healthcare-related services to clients through MediPlace. This includes, but is not limited to: doctors, nurses, dieticians, physiotherapists and other therapists, Ayurveda practitioners, midwives, hospitals, clinics, laboratories, pharmacies, wellness centers, rehabilitation centers, diagnostic labs, and medical tourism agents.
- Clients – means those visitors to or users of the website and/or individuals who contact the Company seeking information on healthcare professionals or healthcare service providers for healthcare services. Unless expressly specified otherwise, reference to a client shall also include the relatives, guardian, or other agent of a client who uses the website or communicates with the Company on behalf of the client.
- Healthcare services – shall refer to the healthcare, medicinal, surgical, therapeutic, or other services to be provided by healthcare professionals and healthcare service providers.
- Intellectual Property Rights – means copyrights, trademarks, service marks, trade dress, trade secrets, publicity rights, database rights, patents, and other intellectual property rights or proprietary rights recognised by law.
- Rates – means the fees charged by the Company to the Clients for the healthcare services.
- Services Offered: The Company acts as a liaison between Clients and healthcare professionals or healthcare service providers, by providing information on healthcare professionals and healthcare service providers and facilitating the process of finding and booking healthcare services.
- Restrictions on usage
- By using Mediplace you acknowledge and agree that you are prohibited from using Mediplace for any of the following purposes.
- To disseminate any unlawful, harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene, pornographic, pedophilic, racially, and ethnically objectionable or otherwise objectionable material.
- To transmit material that encourages conduct that constitutes a criminal offence, results in civil liability, or otherwise breaches any relevant laws, regulations, or code of practice.
- To host, display, upload, modify, publish, transmit, update, or share any information on Mediplace that belongs to Mediplace or any third party and to which you do not have any right.
- To harm minors in any way.
- To deceive or mislead the addressee about the origin of any message or to communicate any information which is grossly offensive or menacing in nature.
- To impersonate another person.
- To use software viruses/corrupt data or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer resource including Mediplace.
- To threaten the unity, integrity, defense, security or sovereignty of Sri Lanka, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
- To violate or attempt to violate the integrity or security of Mediplace or its content.
- To transmit any information (including job posts, messages, and hyperlinks) on or through Mediplace that is disruptive or competitive to the provision of services by us.
- To intentionally submit on Mediplace any incomplete, false, or inaccurate information.
- To use Mediplace to make any unsolicited communications to other users of Mediplace.
- To use any engine, software, tool, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search Mediplace.
- To copy or duplicate in any manner any of the content on mediplace; and To engage in framing or hot linking or deep linking any content on Mediplace.
- To use the site and the services by children under the age of 13.
- Unless otherwise specified in writing, to use services for your personal and non- commercial use.
- Copy, reverse engineer, reverse assemble, otherwise attempt to discover the source code, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products, or services obtained through the Site or the services.
- Delete any author attributions, legal notices or proprietary designations or labels.
- Violate any applicable local, national, or international law, rule or regulation or use the Site and/or the services for any purpose that is prohibited by these terms of use.
- Manipulate or otherwise display the Site and/or the services by using framing or similar navigational technology.
- Register, subscribe or unsubscribe to any party for any Mediplace service if you are not expressly authorized by such party to do so.
- Use the Site or the services in any manner that could damage, disable, overburden, or impair Mediplace’s servers or networks, or interfere with any other user’s use and enjoyment of the Site and/or the services.
- Gain or attempt to gain unauthorized access to any of the Site, services, accounts, computer systems or networks connected to Mediplace through hacking, password mining or any other means.
- Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site or the services or harvest or otherwise collect information about other users without their consent.
- Use the site in any manner that could damage, disparage, or otherwise negatively impact Mediplace. In addition, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, COPYING OR REPRODUCING ANY SERVICES, PROGRAMS, PRODUCTS, INFORMATION OR MATERIALS PROVIDED BY MEDIPLACE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED
- General Terms and Conditions applicable for all services offered through Mediplace:
- The Company does not provide healthcare services directly and does not assume responsibility for the quality of healthcare services provided by healthcare Service Providers.
- Clients are solely responsible for their interactions with healthcare Service Providers.
- Clients shall be responsible for the accuracy of Personal Information provided to Mediplace, for the purposes of scheduling the appointment.
- All Clients hereby agree to provide all required information when scheduling an appointment on Mediplace.
- A Client’s appointment shall be confirmed upon completion and acceptance of the following payments.
- Doctor’s charge
- Mediplace service charge &
- all applicable government taxes and levies.
- For all reserved appointments, Clients shall make the remaining payment prior to the scheduled appointment.
- The Audio/Video Consultation Session shall not be confirmed until the Client’s payment is accepted by the system and confirmed to the Client. The Audio/Video Consultation Session shall be confirmed upon the complete payment of the Healthcare Service Providers charge, Mediplace service charge and all government taxes and levies applicable to the Audio/Video Consultation Service.
- The Client is responsible for having the necessary technical capacity, device and connectivity at the time of appointment to have a successful Audio/Video Consultation Session.
- Mediplace or the Healthcare Service Providers are not responsible for the unavailability of the Client or the Client not being able to accept the voice/video call at the time of the Audio/Video Consultation Session.
- In the event the Client is unable to complete the Audio/Video Consultation Session due to technical failures from the Client’s end and cannot connect the voice/video call within the time slot allocated, the booked Audio/Video Consultation Session will be terminated. In such an event, the Client will not be entitled for a refund.
- The Client hereby agrees to always conduct themselves professionally with the Medical Professionals and shall refrain from using any unprofessional, improper, abusive, obscene, or threatening language.
- Delays by the Healthcare Service Providers – Mediplace shall not be liable in the event of delays by the Healthcare Service Providers and no refunds or cancelation will be made by Mediplace in such an instance.
- In the case of an Audio/Video Consultation Session cancellation by the Healthcare Service Providers, Mediplace shall arrange refunds or reschedule the Audio/Video Consultation Session based on the Healthcare Service Providers’ discretion.
- Mediplace disclaims all liability for any advice given by the Healthcare Service Providers to the Client.
- The Audio/Video Consultation Service is only a pre/post consultation service and is NOT a substitute or an alternate to a physical consultation.
- The Client hereby consents to disclose Personal Information provided by the Client to the Healthcare Service Providers if requested. At the request of the Healthcare Service Providers, Mediplace shall provide the Client’s Personal Information to the Healthcare Service Providers to facilitate a successful Audio/Video Consultation Session.
- The Client hereby agrees that he/she will not use Audio/Video Consultation Service at times of emergency.
- The Client acknowledges and agrees that a chaperone may be present during consultations—including medical, counselling, or allied health sessions—for the purpose of maintaining transparency, safety, and professional standards. The presence of a chaperone will be determined by the Company or the Healthcare Professional. Clients may decline a chaperone, but in doing so, accept full responsibility for any concerns or incidents arising from the session.
- Mediplace shall not under any circumstance disclose personal information of Healthcare Service Providers to the Client.
- You agree to comply with and be bound by these terms and conditions, as well as any additional terms and conditions that may apply to specific portions of our services.
- The Company reserves the right to change or modify these terms and conditions at any time and in our sole discretion.
- If the Company makes changes to these terms, we will provide you with notice of such changes, such as by sending an email, posting a notice on our website or updating the date at the top of the agreement.
- Your continued use of our services will confirm your acceptance of the revised terms.
- Dispute Resolution: Any service-related complaint or concern should first be submitted in writing to MediPlace via email. MediPlace will facilitate resolution in good faith. If a dispute cannot be resolved through informal means, it will be subject to the jurisdiction clause outlined in this agreement.
- Intellectual Property: The content of our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads and software, is the property of the Company and is protected by copyright laws. You may not use any content of our website without the express written consent of the Company.
- Indemnification: You agree to indemnify and hold the Company and its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our services, your violation of these terms and conditions, or your violation of any rights of another.
- Termination: The Company may terminate your access to our services at any time and for any reason, without notice in case of fraud or misconduct. All provisions of these terms and conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
- No Guarantee: MediPlace does not guarantee that the healthcare services arranged through the platform will meet the Client’s expectations, result in desired outcomes, or be suitable for every individual case. The responsibility for diagnosis, treatment, and care lies solely with the respective Healthcare Service Providers.
- Refund: Service charges and Healthcare Service Providers consultation fees are non-refundable once a booking has been scheduled or fulfilled. In exceptional cases, if a refund is approved by MediPlace management, a 20% administrative processing fee will be deducted. Refunds will be processed via the original payment method within 7–14 working days.
- No refund for partially used services: No refund shall be issued for partially completed services, such as:
- Home visits where treatment costs are pending.
- Referral services already initiated (e.g., prescription or lab orders sent).
- Health coordination tasks that have begun (reports given to review, lab services, dental, vision, etc).
- Rescheduling requests:
- Clients may request to reschedule a confirmed service appointment (e.g., doctor visit, lab test, or counseling session) at no extra charge if notified at least 24 hours in advance.
- Clients may reschedule the same appointment up to a maximum of two (2) times.
- For rescheduling requests made less than 24 hours before the scheduled service, the original booking may be forfeited, and re-booking will be subject to provider availability and applicable charges.
- General Terms and Conditions applicable for specific services offered through Mediplace:
- These terms and conditions constitute the entire agreement between the Client and the Company regarding the use of our services. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of the agreement shall remain in full force and effect. The failure of the Company to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.
- By registering with MediPlace, the client agrees to abide by these terms and conditions. Any breach of these terms and conditions may result in the termination of the agreement with MediPlace.
- Pharmacy (Medicine Delivery)
- The medicine is delivered in partnership with pharmacies & other Healthcare Service Providers (ayurvedic medicines) listed in the Mediplace Website. Therefore, Clients are subject to the Terms & Conditions of the respective pharmacy when placing the medicine order.
- Mediplace accepts no liability for the quality of goods and services provided by the service establishments involved since Mediplace is not the supplier of such medical goods and services.
- Mediplace will not be responsible for delays in delivery of the goods.
- It is always recommended to send a VALID prescription for the medicine orders and Mediplace has no liability to verify the prescriptions sent by the Clients.
- In the event of an order cancellation or item/ payment refund the Client should adhere to the cancellation/ refund policies of the pharmacy.
- For cancellations and refunds, the Client should coordinate with the respective pharmacy. Mediplace will not be held responsible for cancellations and refunds.
- Online Laboratory Reports
- The Online Laboratory report is arranged in partnership with Laboratory partners listed in the Mediplace Website. Therefore, Clients are liable for the Terms & Conditions of the respective Laboratory partners when requesting a Laboratory test or mobile laboratory services.
- Any delays in laboratory service will not be borne by Mediplace.
- Mediplace accepts no liability for the quality of laboratory reports since Mediplace is not the supplier of such laboratory services.
- It is strongly recommended that clients submit valid laboratory test requests or prescriptions from a licensed medical professional, as MediPlace is not responsible for verifying the accuracy or validity of the prescriptions or test requests submitted by clients
- Home Visit Doctor Services
- Home visit services are facilitated through independent General Practitioners and Specialists listed on the MediPlace platform. Clients are therefore subject to the individual service provider’s terms and clinical discretion.
- MediPlace acts solely as a coordinating platform and accepts no liability for the clinical decisions, punctuality, or conduct of the doctor.
- Clients must ensure accurate address and availability for the scheduled visit. Delays, rescheduling, or cancellations due to client-side constraints will not be the responsibility of MediPlace.
- All treatment or medical advice provided during a home visit is under the responsibility of the attending doctor, and MediPlace is not accountable for clinical outcomes or follow-up.
- Cancellations or refund requests must follow the doctor’s or service provider’s policy, and all claims must be directly coordinated with them.
- Home Nursing & Caregiver Services
- Home nursing and caregiving services are provided in partnership with third-party licensed caregiving agencies or nursing establishments listed on the MediPlace platform.
- Clients are subject to the Terms & Conditions of the respective service providers. MediPlace bears no responsibility for the conduct, professionalism, or quality of care provided by the assigned caregiver.
- All liability related to medical errors, physical injury, theft, or negligence rests solely with the caregiving agency.
- Clients are encouraged to directly verify credentials and monitor care delivery when possible.
Cancellations, complaints, and refund claims must be resolved through the contracted nursing service provider, and MediPlace shall not intervene in service or payment disputes.
- Physiotherapy (At Home or Virtual)
- Physiotherapy sessions are coordinated with licensed physiotherapists affiliated with MediPlace. Clients agree to the terms set by the respective therapist or clinic.
- MediPlace assumes no responsibility for any injury, lack of therapeutic progress, or scheduling issues. The treatment plan is under the full discretion of the therapist.
- Clients are advised to provide accurate clinical history and to adhere to recommended post-session guidelines.
- Rescheduling must be requested in accordance with the physiotherapist’s policies. MediPlace will not process claims related to therapeutic dissatisfaction or missed appointments.
- Holistic Care (Ayurveda, Siddha, Acupuncture, etc.)
- Holistic services are facilitated through registered traditional practitioners listed on the MediPlace website. Clients must accept the individual terms of the respective service providers.
- MediPlace does not verify or guarantee the efficacy of traditional or alternative treatment methods. Clients are advised to consult a licensed medical practitioner before engaging in such services.
- The platform is not liable for any adverse health outcomes or dissatisfaction resulting from holistic or complementary care.
- Any complaints or session adjustments must be addressed directly with the traditional healthcare provider.
- Clients must follow hospital protocols for cancellations, pre-payments, payment and refund processing.
- Dental, Vision, Skin & Cosmetic Services
- These services are coordinated through licensed dental clinics, eye care centers, dermatologists, and aesthetic providers registered with MediPlace.
- MediPlace is not responsible for the clinical outcomes, procedural risks, or satisfaction levels from services rendered.
- Clients are subject to the terms and treatment protocols of the selected provider.
- MediPlace only facilitates the appointment and does not validate clinical decisions or pricing.
- Clients must follow hospital protocols for cancellations, pre-payments, payment and refund processing
- Rescheduling, and complaints are the sole responsibility of the healthcare establishment offering the service.
- Hospital-Based & Surgical Services
- MediPlace coordinates with hospitals and clinics for surgeries, scans, and inpatient or outpatient services.
- Clients are bound by the operational policies, consent forms, and disclaimers of the respective institutions.
- MediPlace acts only as a liaison and does not influence medical decisions, admission processes, insurance claims, or post-operative care.
- Liability for clinical errors, procedural outcomes, and staff conduct lies solely with the admitting hospital or clinic.
- Clients must follow hospital protocols for cancellations, pre-payments,payement and refund processing.
- MediPlace is not involved in billing disputes or post-care complaints and will only offer administrative assistance in coordinating service requests.
- Data Privacy
- MediPlace collects and processes personal information solely for the purpose of coordinating healthcare services. We do not sell or share personal data with third parties, except as required to fulfill your requested service. For full details, refer to our [Privacy Policy].
- Restrictions on Services
- We have the sole discretion to determine and restrict the services made available to a User. The Users will be notified of such restrictions. We further retain the right to prohibit the provision of any services to any User at our discretion.
- Limitation of Liability
- Neither Mediplace nor its, directors, officers, employees, contractors, agents, or sponsors are responsible or liable to you or anyone else for any loss or injury or damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to
- The use of or inability to use the site and/or the services;
- Any content contained on the site and/or the services;
- Statements or conduct posted or made publicly available on the site and/or the services;
- Any service purchased or obtained through the site and/or services;
- Any action taken in response to or as a result of any information available on the site and/or services;
- Any damage caused by loss of access to, deletion of, failure to store, failure to back up, or alteration of any content on the site and/or services; or
- Any other matter relating to the site and/or the services. In no event shall the total liability of Mediplace to you for any and all damages, losses, and causes of action exceed the amount paid by you, if any, for using the site and/or services.
- Governing Language
- In case of any inconsistency between translated versions of these Terms and the English version, the English version shall prevail.
- Force Majeure
- MediPlace shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, internet or power outages, government actions, or public health emergencies.
- Governing Law & Jurisdiction
- These Terms shall be governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising shall be subject to the exclusive jurisdiction of Sri Lankan courts.
